His son, Welby Lee, now 52, vowed the night his father died he would track down the driver of the car. Jones, an Indianapolis, handyman, was indicted in 1963 after a by the younger Lee. Jones' first trial last November ended in a mistrial minutes before a verdict was expected. The prosecution asked for the mistrial after discovering that two members of the jury were related to defense witnesses.
Several jurors said the panel had reached a verdict of innot. Jones, who says he can neither read nor write, has maintained his innocence. He denied De.ng in Tennessee on the date of the accident or owning a car at that time. Several witnesses at the first trial placed Jones near the accident scene the day Lee was killed.
